Three Doctors have been penalized with a fine of Rs5000 by the Allahabad High Court for poor handwriting. Owing to the unintelligible handwriting, the injury report of three criminals could not be read and understood.
The court observed that the handwriting of the concerned doctors has acted as an obstruction in the judicial work and thus reprimanded them with the fine.
The bench observed that a clearly given medico-legal report has the power to either support an eyewitness' account of an incident or it could also disprove it. The medical reports, as per the bench, however, are furnished in such shabby handwriting which is undecipherable by legal practitioners.
Doctors cited overburden of the work in their defense and that in those conditions they couldn’t put much emphasis on the writing.
The court cited a circular issued by the Director General Medical and Health, Uttar Pradesh in November 2012 which directed the doctors to issue medico-legal reports in a readable format.
It added that medico-legal reports and postmortem examination reports are prepared to help the advocates and judges involved in the dispensation of criminal justice. “If such reports are only able to be read by medical practitioners, they shall not serve the purpose for which they are made,” added the bench.
Probably cursive writing will soon be added as an additional subject in the medical colleges.
